OFFICIAL RULES
1.NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2.Eligibility. Subject to the additional restrictions below, the KRTV Downtown Gift Certificate Giveaway (the “Sweepstakes”) is open to residents of the State of Montana who are 18 years or older at the time of entry and who have not won a prize, and do not reside in the same household as a person who has won a prize, from KRTV within thirty (30) days prior to the start of this Sweepstakes. Employees of KRTV Communications, Inc. or Cordillera Communications, or of any of their respective affiliated companies or advertising or promotional agencies, and employees of any other Great Falls, Montana area television or radio station(s), and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren.
3.How To Enter. The Sweepstakes will begin at 12:00 a.m. (M.T.) on 10/27/2011 and end at 11:59 p.m. (M.T.) on 11/30/2011 (the “Sweepstakes Period”).
Internet Entry: Enter online by visiting the official Sweepstakes registration page on the KRTV website (krtv.com), completing all of the required information and following all posted instructions for submitting your entry.
Mail Entry: To enter by mail, hand print your name, address, daytime telephone number, birth date, and email address on a 3” x 5” card or piece of paper and send it to Downtown Gift Certificate Giveaway, c/o KRTV, P.O. Box 2989, Great Falls, MT 59403. All entries must be postmarked by 11/29/2011 and received no later than 12/1/2011. No facsimiles or mechanical reproductions permitted. Limit one (1) entry per outer stamped envelope.
In-Person Entry: Enter in person by visiting the offices of KRTV, located at 3300 Old Havre HWY, Black Eagle, MT 59414, during regular business hours, completing an Official Entry Form, and depositing your entry form in the designated entry box.
Maximum one (1) entry per person.
Sponsor will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.
4.Winner Selection. One (1) Downtown Gift Certificate Winner will be selected each day on or about 11/1/2011 and each day thereafter through 11/30/2011, in a random drawing from among all eligible entries received.
5.Prizes and Odds. Prizes: Twenty eight (28) Downtown Gift Certificates Prize Winners will receive $300 worth of Downtown Great Falls Gift Certificates (ARV: $300.00).
Odds of winning depend on the number of eligible entries received.
6.Winner Notification and Acceptance. Winners will be notified via announcement in the KRTV 10:00 News starting Wednesday November 3rd 2011 and each night thereafter Monday through Sunday through Wednesday November 30th, 2011. One winner will be announced each night. To claim prize, each winner must personally visit Sponsor’s (KRTV) offices at 3300 Old Havre HWY, Black Eagle, MT 59414 within five (5) business days after notification (office visits must be between the hours of 8 a.m. (M.T.) and 5 p.m. (M.T.) weekdays) and must present a valid photo identification. Winners may waive their right to receive prizes. If for any reason a winner decides not to accept the awarded prize, the winner will be required to sign a release form acknowledging that they are forfeiting the prize. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
7.Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and the Sweepstakes judges designated by Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor.
8.Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
9.Disclaimer/Release. By entering, participants acknowledge and agree that the Sponsor and its parent company, subsidiaries, and affiliates, and the officers, directors, employees, agents and representatives of each of the foregoing companies (collectively, the “Sweepstakes Entities”), will not be liable for losses or injuries of any kind resulting from acceptance/possession/use and/or misuse of any prize(s), the theft of prizes or mail, travel to and from any prize-related activity, participation in the Sweepstakes, printing, mailing or distribution errors, or any malfunctions of the telephone network, computer Internet system, computer dating mechanism, computer equipment, software, or any combination thereof, or for any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, postage-due, forged, illegible, inaudible, mutilated, mechanically duplicated, or mass machine printed entries, or entries otherwise not in compliance with these Official Rules. Sweepstakes Entities are not responsible or liable for any injury or damage to any participant’s or third person’s computer and/or its contents, related to or resulting from Sweepstakes. Sponsor reserves the right to terminate, suspend or modify the Sweepstakes if, at its sole discretion, it determines that for any reason the Sweepstakes is not capable of running as originally planned, or fraud, technical failures, printing, mailing or distribution errors, or any other unanticipated causes or occurrences have compromised the fairness or integrity of the Sweepstakes. In the event the Sweepstakes is terminated prior to the stated end date, Sponsor reserves the right to award the prize(s) in a random drawing from among all eligible entries received as of the date of termination.
10.Sponsor. The Downtown Gift Certificate Giveaway is sponsored by KRTV Communications, Inc. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Sweepstakes. KRTV-TV reserves the right to substitute any prize with another prize of equal or greater value.
KRTV-TV reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of KRTV-TV, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to KRTV-TV the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
KRTV-TV reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or KRTV-TV. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and KRTV-TV are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
KRTV-TV reserves the right to change the rules at any time.
